Terms & Conditions for Accommodation Contract

Article 1 Scope of Application

  1. Accommodation Contract and related agreements to be entered into between the Hotel and the Guest to be accommodated shall be subject to the Terms & Conditions, and any particulars not stipulated herein shall be governed by laws and regulations and/or generally accepted practices in Japan.
  2. In the event when the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and/or generally accepted practices in Japan, notwithstanding the preceding paragraph, the special contract shall take precedence over the provisions of the Terms & Conditions.

Article 2 Application for Accommodation Contract

  1. A person who intends to apply for an accommodation contract with the Hotel shall notify the Hotel of the following particulars:
    • 1) Name of the Guest(s):
    • 2) Contact information;
    • 3) Date of accommodation and estimated time of arrival;
    • 4) Accommodation Charges (based in principle, on the Basic Accommodation Charges listed in the Appendix Table 1); and
    • 5) Other particulars deemed necessary by the Hotel.
  2. In the event that the Guest requests, during his/her stay, extension of the accommodation beyond the dates specified in item 2 of the preceding paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Article 3 Conclusion of Accommodation Contract

  1. An accommodation contract shall be deemed to have been concluded when the hotel has duly accepted the application described in the preceding article. However, the same shall not apply where it has been proved that the Hotel has not accepted the application.
  2. When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, the Guest shall pay an accommodation deposit set by the Hotel within the limits of Basic Accommodation Charges for the Guest's entire period of stay (three days when the period of stay exceeds three days) on or before the date designated by the Hotel.
  3. The accommodation deposit set by the Hotel shall be the total amount payable by the Guest listed in the Appendix Table 1.
  4. The deposit shall first be applied to the total accommodation charges to be paid by the Guest, secondly for cancellation charges under Article 6 and thirdly for reparations under Article 18 as applicable. And the remainder, if any, shall be refunded upon the payment for accommodation as stated in Article 12.
  5. In the event that the Guest fails to pay the deposit as stipulated in paragraph 2 by the date designated by the Hotel, in accordance with the provisions of the same paragraph, the Hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the due date of the deposit payment is designated.

Article 4 Special Contracts Requiring No Accommodation Deposit

  1. Notwithstanding the provisions of paragraph 2 of the preceding article, the Hotel may enter into a special contract not requiring the payment of the deposit as stipulated in the same paragraph after the conclusion of the contract.
  2. In the event that the Hotel has not requested the payment of the deposit stipulated in paragraph 2 of the preceding article and/or has not designated the due date of the deposit payment when accepting the application for an Accommodation Contract, it shall be treated such that the Hotel has accepted a special contract prescribed in the preceding paragraph.

Article 5 Refusal of Accommodation Contract

  1. The Hotel may decline to conclude an accommodation contract in any of the following cases:
    • 1)When the application for accommodation is not made in accordance with the Terms & Conditions;
    • 2)When the Hotle is fully booked and no room is available;
    • 3)When the Guest seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate Japanese laws or act against the public order or good morals in regard to his/her accommodation;
    • 4)When the Guest seeking accommodation is a designated organized crime group and a designated organized crime group member (hereinafter referred to as "organized crime group" and "organized crime group member") under the "Act on Prevention of Unjust Acts by Organized Crime Group Members" (effective March 1, 1992) or its affiliates, or other anti-social forces.
    • 5)When the Guest seeking accommodation is a corporation or other body whose operations are controlled by an organized crime group or an organized crime group member;
    • 6)When the Guest seeking accommodation is a corporation whose director corresponds to an organized crime group member;
    • 7)When the Guest seeking accommodation behaved in a manner that causes serious inconvenience to other guests;
    • 8)When the Guest seeking accommodation makes violence, threats, blackmails, or intimidating unreasonable demands to the facilities or staff (employees) of the accommodation, or demands burden beyond the reasonable range, or if it is observed that the relevant Guest performed the aforementioned act;
    • 9)When the Guest seeking accommodation is clearly identified as a carrier of an infectious disease;
    • 10)When the Hotel is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes; and
    • 11)When the Guest seeking accommodation may cause serious inconvenience to other guests due to drunkenness or the like. Or when the Guest behaves in a manner that causes serious inconvenience to other guests.

Article 6 Right to Cancel Accommodation Contracts by the Guest

  1. The Guest may cancel the Accommodation Contract by notifying the Hotel.
  2. In the event that the Guest cancels the Accommodation Contract in whole or in part due to causes attributable to the Guest (except in the case where the Hotel has requested the payment of the deposit during the designated the due date as prescribed in article 3, paragraph 2, and the Guest has cancelled the Accommodation Contract before the payment), the Guest shall pay cancellation charges as listed in the Appendix Table 2. However, in the event when the Hotel has accepted the conclusion of a special contract as prescribed in article 4, paragraph 1, the same shall apply only when the Guest is informed of the obligation of the payment of the cancellation charges in case of cancellation by the Guest.
  3. In the event when the Guest does not appear by 10:00 p.m. of the accommodation date (or two hours after the expected arrival time notified by the Guest in advance) without an advance notice, the Hotel may regard the Accommodation Contract as being cancelled by the Guest.

Article 7 Right to Cancel Accommodation Contract by the Hotel

  1. The Hotel may cancel the accommodation contract in the following cases:
    • 1) When the Guest is deemed liable to conduct him/herself in a manner that will violate applicable laws or act against public order or good public morals in regard to accommodation, or when it is observed that the Guest actually engaged in such behavior;
    • 2)When the Guest is clearly identified as a carrier of an infectious disease;
    • 3)When the Hotel is unable to provide accommodation due to natural calamities and/or other causes of force majeure;
    • 4)When the Guest seeking accommodation may cause serious inconvenience to other guests due to drunkenness or the like. Or when the Guest behaves in a manner that causes serious inconvenience to other guests.
    • 5)When the Guest is a designated organized crime group and a designated organized crime group member (hereinafter referred to as "organized crime group" and "organized crime group member") under the "Act on Prevention of Unjust Acts by Organized Crime Group Members" (effective March 1, 1992) or its affiliates, or other anti-social forces.
    • 6)When the Guest is a corporation or other body whose operations are controlled by an organized crime group or an organized crime group member;
    • 7)When the Guest is a corporation whose director corresponds to an organized crime group member;
    • 8)When the Guest behaved in a manner that causes serious inconvenience to other guests;
    • 9)When the Guest makes violence, threats, blackmails, or intimidating unreasonable demands to the facilities or staff (employees) of the accommodation, or demands burden beyond the reasonable range, or if it is observed that the Guest actually engaged in such behavior;
    • 10)When the Guest does not comply with the prohibited matters prescribed in the Hotel Rules & Regulations; and
    • 11)When the Guest does not observe the prohibited matters prescribed in the Hotel Rules & Regulations, such as smoking outside the designated smoking areas, mischief to the fire-fighting facilities and others (limited to particulars deemed necessary for fire prevention).
  2. 2. When the Hotel cancels the Accommodation Contract in accordance with the provisions in the preceding paragraph, the Hotel shall not charge the Guest for any accommodation services not yet rendered.

Article 8 Registration of Accommodation

  1. 1. The Guest shall register the following particulars at the front desk of the Hotel on the day of accommodation.
    • 1)Name, age, gender, address, contact information and occupation of the Guest;
    • 2)Nationality, passport number, and place and date of entry into Japan, if the Guest is not a Japanese citizen;
    • 3)Date and estimated time of departure; and
    • 4)Other particulars deemed necessary by the Hotel.
  2. 2. The Guest of foreign nationality who does not reside in Japan will be required to present a photocopy of their passport.
  3. 3. In the event when the Guest intends to pay the accommodation charges prescribed in article 12 by any means other than Japanese currency, such as traveler's cheques, coupons or credit cards, such credentials shall be presented in advance upon the registration prescribed in the preceding paragraph.

Article 9 Occupancy Hours of Guest Room

  1. The Guest is entitled to occupy the contracted guest room of the Hotel from 5:00 p.m. to 1:00 p.m. of the following day. However, in the case of a continuous accommodation, the Guest may occupy the room all day long, except for the days of arrival and departure.
  2. Notwithstanding the provisions in the preceding paragraph, the Hotel may permit the Guest to occupy the room outside the hours stipulated in the same paragraph. In this case, extra charges shall be paid as follows:
    • 1)Overtime of up to 3 hours: 30% of the room charge;
    • 2)Overtime of up to 6 hours: 50% of the room charge; and
    • 3)Overtime of more than 6 hours: 100% of the room charge.

Article 10 Compliance with Hotel Rules & Regulations

  1. Within the premises of the Hotel, the Guest shall comply with the Hotel Rules & Regulations prescribed by and posted in the Hotel.

Article 11 Business Hours

  1. The business hours of the main facilities of the Hotel are as follows, and the details of the service hours of other facilities are announced in the brochures provided, the notices displayed in various places, the service directory in each guest room and others.
    • 1) Service hours for front desk and cashier: 24 hours
    • 2) Closing time: None
  2. The hours specified in the preceding paragraph shall be subject to change temporarily in unavoidable circumstances. In such cases, the Guest will be notified by appropriate means.

Article 12 Payment of Charges

  1. The breakdown of the accommodation charges and other fees to be paid by the Guest and the calculation method thereof shall be as listed in the Appendix Table 1.
  2. Payment of the accommodation charges and other fees described in the preceding paragraph shall be made in Japanese currency or other alternative means acceptable by the Hotel, such as traveler's cheques, coupons or credit cards at the front desk cashier upon arrival or departure of the Guest or upon request by the Hotel.
  3. Accommodation charges shall be charged even if the Guest voluntarily does not stay after the Hotel has provided the Guest with access to the guest room.

Article 13 Liability of the Hotel

  1. The Hotel shall compensate the Guest for the damage in the event when the Hotel has caused such damage to the Guest in the fulfillment or the nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply to the cases where such damage is not caused by reasons attributable to the Hotel.
  2. The Hotel has received the "Certificate of Excellence of Fire Prevention Standard" issued by the fire station" issued by the fire station under the Fire Prevention Object Inspection and Reporting System, furthermore, the Hotel is covered by Hotel Liability Insurance in order to deal with unexpected fire and/or other disasters.

Article 14 Handling When Unable to Provide Contracted Rooms

  1. In the event that the Hotel is unable to provide the Guest with a contracted room, the Hotel shall, with the consent of the Guest, arrange other accommodation facilities to provide a guest room as close as possible to the originally agreed conditions.
  2. When arrangement of an alternative accommodation cannot be made notwithstanding the provisions of the preceding paragraph, the Hotel shall pay the Guest compensation equivalent to the cancellation charges, which shall be applied to the reparations. However, the Hotel shall not compensate the Guest if such unavailability of the guest room is not caused by reasons attributable to the Hotel.

Article 15 Handling of Deposited Items

  1. The Hotel shall compensate the Guest for damage such as loss or breakage is caused to the goods, cash or valuables deposited at the front desk cashier by the Guest, except for the case where such damage has occurred due to force majeure. For cash and valuables, however, when the Guest has not reported its kind and value in advance, the Hotel shall compensate the Guest up to a maximum of 150,000 (one hundred and fifty thousand) yen, except for the case where such damage has been caused by intention or gross negligence of the Hotel.
  2. The Hotel shall compensate the Guest for damage such as loss or breakage is caused, by intention or negligence of the Hotel, to the goods, cash or valuables brought into the Hotel but not deposited at the front desk cashier by the Guest. For cash and valuables, however, when the Guest has not reported its kind and value in advance, the Hotel shall compensate the Guest up to a maximum of 150,000 (one hundred and fifty thousand) yen, except for the case where such damage has been caused by intention or gross negligence of the Hotel.

Article 16 Custody of Baggage or Belongings of the Guest

  1. When the baggage of the Guest is brought into the Hotel prior to his/her arrival, the Hotel shall be liable to keep it only in the case where such a request has been accepted by the Hotel. The baggage shall be handed over to the Guest at the front desk upon his/her check-in.
  2. In the event that the baggage or belongings of the Guest are found left at the Hotel after his/her check-out, the Hotel reserves the right to handle them in accordance with laws and regulations in Japan.
  3. For the custody of the Guest's baggage and belongings prescribed the preceding two paragraphs, the Hotel's liability shall be subject to the provisions of the paragraph of 1 preceding article in the case of paragraph 1, and the provisions of paragraph2of the same article in the case of the preceding paragraph.

Article 17 Liability in Regard to Parking

  1. The Hotel shall not be liable for the custody of the vehicle of the Guest when the Guest uses the parking lot in the Hotel, as it shall be regarded that the Hotel simply offers the space for parking, whether the key of the vehicle has been deposited at the Hotel or not. However, the Hotel shall compensate the Guest for the damage caused by intention or negligence of the Hotel in regard to the management of the parking lot.

Article 18 Liability of the Guest

  1. The Guest shall compensate the Hotel for the damage caused by intention or negligence of the Guest.

Article 19 Disclaimer

The Guests shall be liable for any use of computer communication services within the Hotel. The Hotel shall not be liable for any possible damages incurred as a result of service interruptions due to system failures or any other reasons during the Guest's use of computer communications. In addition, the Guest may be required to compensate the Hotel and third parties for any possible damages caused by the actions that the Hotel deems inappropriate for use of the computer communication systems.

Notes

  • 1) Cancellation charge is calculated from the date when cancellation of contract is notified by the Guest.
  • 2) The percentage signifies the rate of cancellation charge to the Basic Accommodation Charges (Room Charge). However, for accommodation packages including breakfast, the published amount (hereinafter referred to as "Package Charges") shall be collected as the cancellation charge.
  • 3) For contracts where the same guest stays consecutively, the Basic Accommodation Charges (or Package Charges) for the first day shall be paid as the cancellation charge. In addition, if the number of contracted accommodation days are reduced, the cancellation charge for one day (the first day) of accommodation shall be paid, regardless of the number of reduced days.
  • 4) When part of a group booking (for 15 persons or more) is cancelled, the cancellation charge shall not be paid for the number of guests equivalent to 10% or less of the number of guests booked (rounded up to the nearest whole number) as of 10 days prior to the occupancy (or if the reservation is made less than 10 days prior to the occupancy, as of the date).
  • 5) In addition, accommodation packages planned by the Hotel or for specific groups may stipulate cancellation charge that differ from the above provisions.

Hotel Rules & Regulations

In order to ensure a safe and comfortable stay of all Guests at the Hotel, the Hotel kindly ask all Guests to observe the following Rules & Regulations in accordance with the Article 10 of the Terms & Conditions for Accommodation Contract.
Please kindly note that the Hotel may refuse to allow any Guest who fails to comply with the Rules & Regulations to stay at the Hotel and use its facilities, and may ask him/her to compensate for any damages caused to the Hotel.

Precautions for Fire Prevention

  1. Please make sure to check the "Emergency Escape Routes Map" posted on the back of each guest room door
  2. Please refrain from using any appliances for heating or cooking and candles that may cause a fire in the premises without permission of the Hotel. Cooking in the guest rooms is strictly prohibited.
  3. Smoking is not allowed in the entire facility. Please do not smoke outside the designated smoking areas.
  4. Please do not hang clothes and/or dry laundry on the lampshade.
  5. Please retrain from any and all other actions that may cause a fire.

Use of Guest Room

  1. Please make sure that the door is locked upon leaving the room during the stay.
  2. Please make sure that the door guard is locked during the stay, especially while sleeping.
  3. When someone knocks on the door, please open the door with the door guard on, or identify the visitor through the peep hole before opening the door. If the visitor at the door is unfamiliar, please do not open the door and call the front desk.
  4. Please refrain from inviting visitors into the guest room.
  5. Please do not use the guest room for purposes other than accommodation, such as business activities (exhibitions and others) without the permission of the Hotel.
  6. Please do not move the equipment in the guest room, or make any significant changes including adding or remodeling to the guest room, without the permission of the Hotel. In the event that any of the equipment is damaged or lost by the Guest, the Hotel may ask the Guest for compensation equivalent to the actual amount. Please do not take any item or equipment out of the guest room. Please do not place anything on the guest room window that may adversely affect the external appearance of the Hotel.
  7. A long-term accommodation contract does not grant any leasehold right, residency right, or other rights under the Act on Land and Building Leases or other laws related to residency in Japan.
  8. Minors alone are not allowed to stay at the Hotel without parental permission.

Handling of Valuables and Deposits

  1. Please keep cash, securities, precious metals, and other valuables in the in-room safe box in the guest room or in the safe deposit box at the front desk (free of charge).
    The Hotel may not be liable for any loss or theft of such valuables if the Guest does not use such in-room safe or safe deposit box. Please note that artworks, antiques, furs, and other items will not be accepted for safekeeping. The use of the in-room safe or safety deposit box by the Guest is limited to the duration of his/her stay. If the Guest depart without informing the Hotel while the in-room safe or safe deposit box is in use, the Hotel may charge the Guest for the key replacement and the storage fee. In addition, the Hotel may not be liable for any loss of items kept in such in-room safe or safety deposit box.
  2. Items deposited to the Hotel by the Guest shall be handed over only to the person who has the exchange receipt. The Hotel shall not be liable for any damages incurred as a result of the loss of the exchange receipt, regardless of the cause, such as loss or theft. In addition, we shall not be responsible for the loss of items after delivery.
  3. The Hotel reserves the right to handle all items found left in the Hotel in accordance with laws and regulations in Japan.
  4. Items deposited to the Hotel by the Guest will be kept for a period of three months, after which the Hotel reserves the right to dispose them as unnecessary.

Payment

  1. Payment shall be made at the front desk upon arrival or departure of the Guest. The Guest may be asked to settle charges upon request by the Hotel even during the stay. If the payment is not made upon the Hotel's request, the Guest may be requested to vacate the room.
  2. Payment for the accommodation charges and other fees shall be made in cash, traveler's cheques, coupons, credit cards or other means acceptable by the Hotel. Bills and checks are not accepted.
  3. Please note that the Guest may be asked to present his/her credit card or pay a deposit upon arrival.
  4. The Guest is required to present his/her room key when using the restaurants, shops, and other facilities in the Hotel by signing.
  5. In the event that payment is made by a person other than the registered Guest, and is not made by the designated date, the Hotel will directly request payment to the registered Guest.
  6. The Hotel shall not make payment on behalf of the Guest for shopping, ticket fares, taxi fares, postage fees, shipping fees, and other expenses.

Use of the Parking Lot

  1. The use of the parking lot by the Guest is limited to the duration of his/her stay.
  2. The Guest is required to follow the guidance and instructions of the staff in the parking lot.
  3. Please do not leave valuables or other items in the car while parking. The Hotel shall not be liable for any loss or theft of such valuables while parking.
  4. Please refrain from parking at the entrance of the Hotel.
  5. Cars parked outside the designated space by the hotel staff may be towed. The towing charge shall be borne by the Guest.
  6. The hotel staff shall not transfer cars for The Guest (valet service).
  7. The Hotel shall not be liable for damage or accident incurred as a result of the actions of other users or vehicles in the parking lot while parking.

Prohibited Matters

  1. The Guest is not allowed to bring the following items or behave in a manner that causes inconvenience to other guests in the Hotel.
    • 1) Animals, birds, and other pets (Excluding assistance dogs);
    • 2) Items that emit a noticeably malodor or high sound level;
    • 3) Gunpowder, volatile oil, or other ignitable or flammable materials;
    • 4) Guns, swords, and stimulants that are legally prohibited to be possessed in Japan;
    • 5) Gambling or any other activity that disturbs public morals or any behavior that causes inconvenience to other guests;
    • 6) Distribution or posting of advertisements or promotional materials, leaving personal belongings unattended, selling goods, soliciting, holding parties, filming, business activities, distribution of leaflets, demonstration with placards, number bibs, headband, and banners, or bringing in such items, signing petitions, political activities, and other similar activities in the premises without permission of the Hotel;
    • 7) Printing the name and address of the facilities of the Hotel, or using trademarks, designs, or other rights owned by the Hotel without permission of the Hotel;
    • 8) Using the guest rooms by anyone other than the registered Guests;
    • 9) Ordering or bringing food and beverages from outside the Hotel without permission of the Hotel (For using an external delivery service, please pick up the orders at the lobby);
    • 10) Assaults, injuries, threats, blackmails, coercive unreasonable demands, and other similar behaviors;
    • 11) Having difficulty in ensuring his/her own safety due to loss of self-control caused by mental exhaustion or similar conditions, who may cause danger, fear, or uneasiness to other guests;
    • 12) Interfering with the exercise of rights and compelling others to do things they are not obligated to do;
    • 13) Asking for a burden that exceeds a reasonable range;
    • 14) Interfering with business by using deceptive means (including spreading false information, swindling, or seducing others) or force (including abusive language or violence).;
    • 15) Loud voices, singing, making noise, or extremely unclean body or clothing that causes serious inconvenience to other guests;
    • 16) Using the public baths and other similar facilities with tattooed skin (In the event that a Guest with tattoo is discovered, he/she will be asked to leave the facilities);
    • 17) Entering by or parking a street advertising vehicle, altered vehicle, or other similar vehicles in the premises of the Hotel that the Hotel deems may cause uneasiness or inconvenience to other guests; and
    • 18) Engaging in any other behaviors that the Hotel deems inappropriate.

Others

  1. In the event that the facilities, furniture, fixtures, equipment, or other items in the Hotel are damaged, lost, or contaminated by the Guest, due to reasons other than force majeure, the Hotel shall ask the Guest for compensation equivalent to the actual amount.
  2. The hotel is not liable for any accidents not attributable to the Hotel, injuries caused by the carelessness of the Guest, or injuries caused by animals or plants not kept by the Hotel in the premises.
  3. The facilities in the Hotel may not be available for use due to unforeseen circumstances including damages caused by natural disasters, large-scale failures, spread of infectious diseases, breakdown of the facilities, or other unavoidable reasons such as orders or instructions from the national or local governments in Japan or other force majeure events.
  4. The Rules & Regulations are written in both Japanese and English. In the event of any inconsistency or difference between the two versions of the provisions, the Japanese version shall prevail in all respects. Any dispute arising in relation to the provisions shall be referred to the Japanese court having Jurisdiction over the location of the Hotel and resolved in accordance with applicable Japanese laws.
  5. The Hotel reserves the right to modify or amend the Rules & Regulations without prior notice.
